Proving Fault in a Slip and Fall Accident

Accidents happen. But if you were injured as a result of dangerous conditions – on public property, private property, or at a commercial enterprise – you may be the victim of a premises liability accident.[1] Property owners have a responsibility to keep their premises safe. While it is impossible to prevent every accident and injury, property owners are legally bound to exercise the same care as any responsible person would when keeping their property safeguarded. Not only do property owners have to take the necessary precautions to prevent dangerous conditions, but they also have to notify people of potential dangers due to slippery or unsafe surfaces. For example, if a floor has recently been mopped and is still wet, a sign should be displayed to warn clients and customers about the potentially slippery surfaces. Failure to do so may be viewed as negligence on the part of the business owner.

Falls are some of the most common types of injuries.

These types of incidents commonly involve negligence in dealing with potential indoor and outdoor hazards such as:

  • Ice and snow
  • Wet floors and walkways
  • Cluttered aisles
  • Fallen merchandise
  • Damaged floors or stairs
  • Stairs with broken or missing handrails
  • Loose carpeting or linoleum
  • Loose cables or wires
  • Construction debris
  • Poor lighting
  • Improperly maintained elevators and escalators
  • Failure to post signs warning of hazards

In order to obtain compensation for your injuries in a slip and fall accident, you must prove that the property owner did not maintain its property properly and that it failed to warn you of dangerous conditions. At Ganim Law, we can help you gather evidence to prove your case.

If you believe you are the victim of a Slip & Fall case, contact Attorney Raymond Ganim today at 203-377-7700. We can guide you through the process, aid you in gathering evidence, and help you determine if you want to settle your case or take it to trial.

[1] It is important to distinguish that if you are at least partially responsible for the injuries you sustained in a public place, you may only receive partial compensation or no compensation at all for your injuries. For example, if you tripped on a sidewalk in a public place because you were running, this is not entirely the fault of the business. A business does not have to warn a customer against the customer’s own careless behavior.
